Terms of Use

These Terms of Use govern your access to and use of the StaySafe Verified™ website, StayHub™, the Trusted Stay™ Program, the Trusted Stay™ Builder, Trusted Stay™ Profiles, Trusted Stay™ Badge features, host accounts, guest-facing property pages, and related online services.
These Terms constitute a legally binding agreement between you and StaySafe Verified LLC, a Pennsylvania limited liability company.
Please read these Terms carefully. By creating an account, selecting a box indicating your acceptance, purchasing a membership, submitting a Trusted Stay Profile, publishing a StayHub, opening or using a StayHub, or otherwise accessing the Services, you agree to these Terms.
Do not use the Services if you do not agree to these Terms.
1. Definitions
For purposes of these Terms:
“StaySafe Verified,” “we,” “us,” and “our” refer to StaySafe Verified LLC.
“Services” means the StaySafe Verified website, StayHub, the Trusted Stay Builder, Trusted Stay Profiles, the Trusted Stay Program, Trusted Stay Badge functions, host dashboards, guest-facing pages, account features, review workflows, and related online services.
“Host” means a property owner, property manager, authorized representative, or other person who creates or manages a property account.
“Guest” means a person who accesses a published StayHub or other guest-facing property information.
“Property” means the lodging, rental, accommodation, or other hospitality location associated with a Host account.
“StayHub” means the property-specific guest-information experience created and published through the Services.
“Trusted Stay Builder” means the system through which a Host provides property information used to organize a StayHub and prepare a Trusted Stay Profile.
“Trusted Stay Profile” means the property-information record submitted by a Host for review through the Trusted Stay Program.
“Trusted Stay Badge” means the property-specific, status-controlled mark that may be displayed after StaySafe Verified reviews and approves an applicable Trusted Stay Profile.
“User Content” means information, text, photographs, videos, documents, property details, instructions, evidence, recommendations, messages, and other materials submitted through the Services.
2. Eligibility and Authority
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account, purchase a membership, submit a property for review, or publish a StayHub.
By using the Services on behalf of a company, property owner, property manager, organization, or other person, you represent that you have authority to bind that person or organization to these Terms.
A person under 18 may access guest-facing information only with the involvement and supervision of a parent or legal guardian.
3. Electronic Acceptance
You agree that electronic actions may demonstrate your acceptance of these Terms, including:
- Creating an account
- Checking an acceptance box
- Clicking an acceptance, purchase, submission, or publication button
- Completing a membership transaction
- Submitting a Trusted Stay Profile
- Publishing a StayHub
- Continuing to use the Services after being presented with updated Terms
Electronic records and communications may be used to document your acceptance, transactions, submissions, approvals, publication choices, and account activity.
4. The Role of StaySafe Verified
StaySafe Verified provides a hospitality-information organization, publication, and review platform.
StaySafe Verified is not:
- The owner or operator of a listed Property
- A property manager
- A landlord
- A booking platform
- A travel agent
- A party to a reservation or rental agreement
- An emergency-response provider
- A governmental authority
- A code-enforcement agency
- A property-inspection agency
- An insurer
- A guarantor of a Property or Host
StaySafe Verified does not control a Property's physical condition, daily operation, maintenance, staffing, cleanliness, security, availability, accessibility, regulatory compliance, or suitability for a particular person.
Any professional consulting services provided by StaySafe Verified are governed by a separate written proposal, statement of work, contract, or engagement agreement. These Terms do not replace the terms of a separately contracted consulting engagement.
5. Account Registration
Hosts may be required to create an account to access certain Services.
You agree to provide accurate, current, and complete account information and to update that information when it changes.
You are responsible for:
- Protecting your account credentials
- Using an appropriately strong and unique password
- Restricting access to your account and devices
- Reviewing activity performed through your account
- Immediately reporting suspected unauthorized access
- Ensuring that every person using your account is authorized
You may not sell, transfer, rent, sublicense, or share an account with an unauthorized person.
StaySafe Verified may require identity, property-authorization, or account-verification information when reasonably necessary to protect the Services or other users.
6. Host Authority and Responsibilities
By creating or managing a Property through the Services, the Host represents and warrants that the Host:
- Owns the Property or has sufficient authority from the owner to submit, manage, and publish information about it.
- Has the right to submit all User Content associated with the Property.
- Has obtained any necessary permissions from photographers, guests, employees, contractors, property owners, or other persons whose content or information is submitted.
- Will provide information that is accurate, complete, current, and not misleading.
- Will review all generated, organized, or suggested content before publication.
- Will promptly update information when property conditions, amenities, equipment, rules, access procedures, contact methods, or other material facts change.
- Will comply with applicable laws, contracts, booking-platform rules, association requirements, licensing requirements, and insurance obligations.
- Will not use the Services to misrepresent the Property or conceal a material condition.
- Will not imply that StaySafe Verified owns, manages, inspects, certifies, guarantees, or insures the Property.
- Will use the Trusted Stay Badge only as expressly authorized by these Terms and the Property's current status.
The Host remains solely responsible for the Property, its operation, the accuracy of published information, and communications with Guests.
7. Public Nature of a Published StayHub
A published StayHub is not an authenticated or confidential storage location.
Anyone who receives, opens, scans, or is forwarded a published Property link or QR code may be able to view the information published through that StayHub.
The public version of StayHub does not independently determine whether a viewer:
- Has a valid reservation
- Is a confirmed Guest
- Is currently staying at the Property
- Received the link directly from the Host
- Is authorized by a booking platform
Hosts must publish only information appropriate for public guest-facing access.
StaySafe Verified is not responsible when a published link or QR code is copied, photographed, forwarded, shared, indexed, or accessed by a person other than the intended Guest.
8. Access Credentials and Prohibited Sensitive Information
The Services are not designed to store or publicly communicate sensitive property-access credentials.
You must not enter, upload, publish, transmit, or store through StayHub, the Trusted Stay Builder, public previews, contact forms, review submissions, notices, or other general-purpose fields:
- Door codes
- Gate codes
- Lockbox combinations
- Keypad codes
- Alarm codes
- Safe combinations
- Temporary access credentials
- Wi-Fi passwords
- Booking-platform passwords
- Account passwords
- Social Security numbers
- Government identification numbers
- Full payment-card numbers
- Card-security codes
- Bank-account credentials
- Medical records
- Other sensitive passwords or security credentials
Hosts should deliver access credentials and Wi-Fi passwords privately through a booking platform, a printed welcome card at the Property, direct communication, or another appropriate private method.
StayHub may identify the approved delivery method, such as:
“Your Wi-Fi password is provided on the welcome card beside the router.”
The actual password must not be included.
StaySafe Verified may use automated or manual controls to identify, block, remove, redact, or reject prohibited information. These controls are supplemental safeguards and do not transfer responsibility away from the person submitting the information.
9. Automated Organization and Generated Content
The Services may use templates, rules, automated systems, or artificial-intelligence-assisted features to organize Host responses, prepare draft language, generate summaries, support search, or create guest-facing content.
Automated output may contain errors, omissions, outdated information, or language that does not accurately reflect a particular Property.
The Host must review and approve all generated content before publication.
StaySafe Verified does not guarantee that automated content, search responses, summaries, or suggested wording will be complete, accurate, suitable, or free from error.
Host approval of generated content constitutes the Host's confirmation that the content is accurate and appropriate for publication.
10. StayHub Publication
A Host may be required to complete specified steps before publishing a StayHub.
Publication requirements may include:
- Completing required property-information fields
- Reviewing generated content
- Approving the public preview
- Completing host attestations and acknowledgments
- Maintaining an active membership
- Resolving prohibited or incomplete content
- Confirming publication choices
Publication of a StayHub does not mean that the Property has earned a Trusted Stay Badge.
A StayHub may be published without an active Trusted Stay Badge when applicable publication requirements have been satisfied.
StaySafe Verified may delay, reject, suspend, or remove publication when information:
- Violates these Terms
- Contains prohibited credentials
- Appears fraudulent or materially misleading
- Infringes another person's rights
- Creates a security concern
- Is associated with an unauthorized account
- Exposes StaySafe Verified or another person to unreasonable legal or operational risk
11. Trusted Stay Profile Review
A Host may submit a completed Trusted Stay Profile and supporting materials for review.
The Host acknowledges that:
- Submission does not guarantee approval.
- Payment does not purchase approval.
- Membership does not automatically create an active Badge.
- Review may be based substantially on Host-submitted information.
- StaySafe Verified may request clarification, correction, photographs, videos, documents, attestations, or other supporting information.
- StaySafe Verified is not obligated to conduct an in-person Property inspection.
- StaySafe Verified may rely on the Host's representations unless additional verification is specifically undertaken.
- StaySafe Verified may decline, defer, suspend, expire, or revoke a status when requirements are not satisfied.
Possible review outcomes may include statuses such as:
- Approved or active
- Additional information required
- Not approved
- Suspended, expired, or revoked
The specific statuses and review procedures available through the Services may evolve as the Program is developed.
12. Meaning and Limits of the Trusted Stay Badge
The Trusted Stay Badge reflects StaySafe Verified's review and approval of the Host's submitted Trusted Stay Profile under the Program requirements in effect at the time of review.
The Trusted Stay Badge is not:
- A property inspection
- A governmental approval
- A building-code inspection
- A regulatory audit
- A safety certification
- An insurance policy
- A guarantee of safety
- A guarantee of property condition
- A guarantee of legal compliance
- A cleanliness guarantee
- A security guarantee
- A ranking or rating
- A warranty
- A substitute for a Guest's judgment or due diligence
Property conditions may change after a review. Equipment may fail, information may become outdated, and hazards may arise without StaySafe Verified's knowledge.
Guests should not rely on the Badge as a promise that no accident, injury, crime, illness, property loss, service interruption, or other adverse event will occur.
13. License to Display the Trusted Stay Badge
When a Property has an active and approved Trusted Stay status, StaySafe Verified grants the authorized Host a limited, nonexclusive, revocable, nontransferable license to display the approved Badge for that Property.
The Host may not:
- Modify the Badge
- Create a substitute Badge
- Remove status information or qualifications
- Use the Badge for a different Property
- Transfer the Badge to another Host
- Display an expired, suspended, or revoked Badge
- Imply that the Badge covers services or claims beyond the approved Program
- Use the Badge in a deceptive or misleading manner
- State or imply that the Property is “certified safe,” “guaranteed safe,” or “independently inspected” unless separately and expressly authorized in writing
The Badge license ends immediately when the applicable status expires, is suspended, is revoked, or is otherwise made inactive.
StaySafe Verified may technically disable or remove a Badge display when the Property is no longer eligible.
14. Continuing Host Obligations
The Host must keep Property information current.
The Host must promptly update or notify StaySafe Verified of material changes involving matters such as:
- Property ownership or management
- Property address or identity
- Guest-access procedures
- Emergency contact information
- Amenities or utility systems
- Smoke or carbon-monoxide alarms
- Fire extinguishers
- Pools, spas, fireplaces, grills, water features, or outdoor areas
- Accessibility information
- Construction or renovation
- Significant damage
- Government restrictions or enforcement actions
- Insurance status when relevant to the Program
- Any other fact that could make the submitted Profile materially inaccurate
StaySafe Verified may require periodic reconfirmation, updated attestations, new evidence, or resubmission.
Failure to provide current information may result in a notice, publication restriction, status suspension, expiration, revocation, or account action.
15. Guest Use of StayHub
StayHub is intended to help Guests locate Host-provided property information.
Guests acknowledge that:
- Most Property information originates with the Host.
- StaySafe Verified does not control the Property.
- Information may be incomplete, incorrect, delayed, or outdated.
- Search results are based on available published content.
- StayHub is not an emergency-response system.
- StayHub does not replace communications from the Host or booking platform.
- StayHub does not replace posted signs, equipment instructions, governmental notices, or emergency directions.
- Local recommendations are informational and are not endorsements or guarantees.
In an emergency, Guests should contact 911 or the applicable local emergency service and follow instructions from appropriate authorities.
Guests should contact the Host or property manager regarding Property-specific access, maintenance, reservation, or operational issues.
16. User Content
You retain ownership of User Content you submit, subject to the licenses granted in these Terms.
You grant StaySafe Verified a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, process, organize, adapt, display, publish, transmit, and use User Content as reasonably necessary to:
- Operate the Services
- Create previews
- Generate StayHub content
- Publish Host-approved information
- Conduct Trusted Stay reviews
- Manage Trusted Stay status
- Provide customer support
- Maintain audit and version histories
- Prevent abuse and protect the Services
- Comply with law
- Use approved service providers to perform these functions
This license permits StaySafe Verified to create technical copies, thumbnails, reformatted versions, backups, and other adaptations required to operate the Services.
StaySafe Verified will not use identifiable Property photographs or Host content in unrelated advertising without permission, except that publicly published content may appear in ordinary demonstrations of the Host's own StayHub or as otherwise authorized.
You represent that your User Content:
- Is accurate to the best of your knowledge
- Does not infringe intellectual-property, privacy, publicity, contractual, or other rights
- Is not fraudulent, defamatory, unlawful, or materially misleading
- Does not contain malware or harmful code
- Does not contain prohibited credentials or sensitive information
- May lawfully be processed and published as directed by you
17. Content Removal
StaySafe Verified may remove, restrict, redact, or refuse to publish User Content when we reasonably believe it:
- Violates these Terms
- Contains prohibited credentials
- Is inaccurate or materially misleading
- Infringes another person's rights
- Creates a privacy or security risk
- Violates applicable law
- Is abusive, discriminatory, threatening, or defamatory
- Contains malware or harmful technical content
- Is unrelated to the Services
- Creates unreasonable risk to StaySafe Verified, a Host, a Guest, or another person
StaySafe Verified is not required to monitor all User Content and does not assume responsibility for failing to identify a violation.
18. Prohibited Conduct
You may not use the Services to:
- Violate any law or regulation
- Misrepresent your identity, authority, Property, or relationship with StaySafe Verified
- Create an account for a Property without authorization
- Publish false or misleading information
- Impersonate another person
- Submit prohibited access credentials
- Harass, threaten, discriminate against, or defame another person
- Upload malware, spyware, ransomware, viruses, or harmful code
- Attempt to gain unauthorized access to accounts, systems, or data
- Bypass security, rate limits, permissions, or technical restrictions
- Scrape, crawl, harvest, or systematically copy information without written permission
- Reverse engineer or attempt to extract source code except where expressly permitted by law
- Interfere with the operation or security of the Services
- Use automated systems to create accounts or submit content without authorization
- Resell or commercially exploit the Services without written permission
- Copy or misuse the StaySafe Verified, StayHub, or Trusted Stay brands
- Display a false, altered, inactive, or unauthorized Badge
- Use the Services to facilitate fraud or unlawful activity
- Submit information about another person without an appropriate lawful basis or authorization
19. Memberships and Fees
Certain Services may require a paid annual Property membership.
The applicable checkout page will disclose:
- The membership price
- The billing period
- Whether the membership is a one-time annual term or automatically renewing
- The Services included
- Applicable taxes
- Any promotional terms
- The cancellation method
- Any refund terms
- The date or conditions under which another charge may occur
You agree to pay the fees presented to you before completing the transaction.
A membership fee pays for the applicable platform access and Services. It does not purchase or guarantee:
- Trusted Stay approval
- An active Trusted Stay Badge
- Any particular review outcome
- Increased bookings
- Positive guest reviews
- Increased revenue
- Reduced liability
- Insurance coverage
- Regulatory approval
Unless otherwise stated at checkout, each Property requires its own membership.
20. Automatic Renewal
The checkout page must clearly state whether a membership automatically renews.
When automatic renewal applies, you authorize StaySafe Verified or its payment provider to charge the applicable payment method for each renewal term unless you cancel before the disclosed renewal deadline.
Before you enroll, the checkout flow must clearly disclose:
- That the membership will renew automatically
- The amount or method for determining the renewal charge
- The length of the renewal term
- The frequency of charges
- How and when to cancel
- Any deadline for avoiding the next charge
Cancellation prevents future renewal. Unless required by law or expressly stated otherwise, cancellation does not automatically terminate the Services or generate a prorated refund for the remaining portion of the current annual term.
StaySafe Verified may send renewal reminders or account notices when required by law or adopted as part of the membership process.
21. Cancellation
A Host may cancel future renewal through the cancellation method identified in the account or checkout terms.
Cancellation generally takes effect at the end of the current paid term unless otherwise stated.
After the membership ends:
- The Host may lose access to paid account features.
- A published StayHub may be unpublished or restricted.
- The Property's QR destination may display an inactive or unavailable status.
- The Trusted Stay Badge may become inactive if an active membership is a continuing Program requirement.
- Certain records may be retained as described in the Privacy Policy.
StaySafe Verified must not intentionally make cancellation unreasonably difficult.
22. Refunds
Except where required by law or expressly stated at checkout, membership and service fees are nonrefundable after the applicable Services have been activated or made available.
StaySafe Verified may issue a refund, credit, or accommodation at its discretion. Doing so in one situation does not require us to do so in another.
Denial, suspension, expiration, or revocation of a Trusted Stay status does not by itself create a right to a refund because membership does not purchase Badge approval.
This section does not limit any nonwaivable rights available under applicable law.
23. Price Changes
StaySafe Verified may change membership prices for future purchases or renewal terms.
When an existing automatically renewing membership is affected, notice will be provided as required by applicable law and before the new price is charged.
Continuing an automatically renewing membership after receiving appropriate notice constitutes acceptance of the updated renewal price, subject to applicable law and the right to cancel before renewal.
24. Payment Processing
Payments may be processed by a third-party payment-services provider.
By submitting payment information, you:
- Represent that you are authorized to use the payment method
- Authorize the applicable charge
- Agree to provide accurate billing information
- Agree to pay applicable taxes and fees
- Acknowledge that the payment provider maintains its own terms and privacy practices
StaySafe Verified does not intend to store full payment-card numbers or card-security codes on its own systems.
25. Privacy
Our collection and use of personal information are described in the StaySafe Verified Privacy Policy.
The Privacy Policy is incorporated into these Terms by reference.
You acknowledge that:
- Published StayHub information may be publicly accessible.
- Review evidence is not automatically published.
- Technical and account information may be processed to operate and protect the Services.
- Approved service providers may process information on our behalf.
- No electronic system can guarantee absolute security.
You must review the Privacy Policy before submitting personal or Property information.
26. Third-Party Services
The Services may link to or interact with third-party products and services, such as:
- Booking platforms
- Payment processors
- Mapping providers
- Email services
- Cloud hosting
- Local businesses
- Restaurants
- Attractions
- Emergency or governmental resources
- External websites
StaySafe Verified does not control and is not responsible for third-party services, availability, content, pricing, security, privacy practices, products, or conduct.
A link or reference does not necessarily constitute endorsement.
Your use of a third-party service is governed by that third party's terms and policies.
27. Intellectual Property
The Services, website design, software, templates, workflows, text, graphics, icons, search functions, compilations, documentation, and other materials provided by StaySafe Verified are owned by or licensed to StaySafe Verified and are protected by intellectual-property laws.
Subject to these Terms, StaySafe Verified grants you a limited, revocable, nonexclusive, nontransferable license to use the Services for their intended purpose.
You may not copy, distribute, reproduce, modify, create derivative works from, sell, license, or commercially exploit StaySafe Verified materials except as expressly authorized.
StaySafe Verified™, StayHub™, Trusted Stay™, Trusted Stay Profile™, Trusted Stay Builder™, and related names, logos, designs, and marks are trademarks or claimed trademarks of StaySafe Verified LLC.
No trademark license is granted except for the limited property-specific Badge license expressly described in these Terms.
28. Feedback
You may provide suggestions, comments, or ideas about the Services.
You grant StaySafe Verified the right to use feedback without restriction or compensation, provided that we do not publicly identify you as the source without permission.
Feedback does not include confidential business information submitted under a separate written confidentiality agreement.
29. Service Availability and Changes
The Services may evolve over time.
StaySafe Verified may:
- Add, remove, modify, or discontinue features
- Change workflows or interface designs
- Update publication requirements
- Revise Program requirements
- Perform maintenance
- Address security issues
- Limit usage
- Suspend particular functions
- Replace third-party providers
We do not guarantee uninterrupted, error-free, or continuously available service.
We will use reasonable efforts to avoid materially reducing paid Services during an active term without notice, but temporary outages, maintenance, provider failures, and circumstances beyond our reasonable control may occur.
30. Beta, Preview, and Demonstration Features
Certain features, prototypes, demonstrations, or preview environments may be labeled beta, pilot, concept, preview, test, or future.
Such features:
- May be incomplete
- May contain errors
- May not reflect the final production system
- May change or be withdrawn
- Must not be relied upon as committed functionality
- May use synthetic demonstration data
A demonstration of a completed Property does not establish that an actual Property has completed the same requirements or earned the same status.
31. Suspension and Termination
StaySafe Verified may restrict, suspend, or terminate an account, publication, review, Badge status, or access to the Services when we reasonably believe:
- These Terms have been violated
- Fees are unpaid
- Information is fraudulent or materially misleading
- The Property is unauthorized
- Prohibited credentials have been submitted
- Account security has been compromised
- The Services are being abused
- Continued access creates legal, safety, security, or reputational risk
- Required information is not updated
- A governmental or legal request requires action
- A Host has misused the Badge or StaySafe Verified marks
When practical, we may provide notice and an opportunity to correct the issue. Immediate action may be taken when reasonably necessary.
Termination does not eliminate payment obligations or liabilities that arose before termination.
32. Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided “as is” and “as available.”
StaySafe Verified disclaims all express and implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and quiet enjoyment.
StaySafe Verified does not warrant that:
- The Services will be uninterrupted or error-free
- All content will be complete or accurate
- A Host will receive a particular review outcome
- A Property will remain in the same condition
- A Badge will prevent injury, loss, damage, crime, illness, or disputes
- Use of the Services will increase bookings, revenue, or reviews
- The Services will satisfy every law, regulation, booking-platform rule, or insurance requirement
- Automated or generated content will be free from error
- The Services will be completely secure
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent permitted by law.
33. Limitation of Liability
To the maximum extent permitted by law, StaySafe Verified and its owners, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, lost data, business interruption, reputational harm, or loss of goodwill.
To the maximum extent permitted by law, StaySafe Verified will not be liable for claims arising from:
- A Property's condition or operation
- A Host's acts or omissions
- A Guest's acts or omissions
- Inaccurate or outdated Host information
- Access credentials shared outside the Services
- A reservation or rental agreement
- Third-party products or services
- Property damage
- Personal injury
- Theft or criminal activity
- Weather or natural events
- Utility or internet failure
- Automated or generated content
- Unauthorized access to a published link
- Reliance on a Trusted Stay Badge beyond its expressly stated meaning
To the maximum extent permitted by law, StaySafe Verified's total aggregate liability arising from or relating to the Services or these Terms will not exceed the greater of:
- The amount you paid to StaySafe Verified for the applicable Services during the 12 months before the event giving rise to the claim; or
- One hundred U.S. dollars.
These limitations do not apply to liability that cannot legally be limited, including liability resulting from willful misconduct or other liability that applicable law prohibits from being excluded.
34. Host Indemnification
To the maximum extent permitted by law, a Host agrees to defend, indemnify, and hold harmless StaySafe Verified and its owners, officers, employees, contractors, service providers, and affiliates from claims, liabilities, damages, losses, judgments, penalties, costs, and reasonable legal fees arising from or relating to:
- The Host's Property
- The Host's operation or management of the Property
- User Content submitted by or for the Host
- Inaccurate, incomplete, outdated, or misleading information
- The Host's violation of law, contract, or booking-platform requirements
- The Host's violation of another person's rights
- Unauthorized submission or publication of content
- Submission of prohibited credentials
- Misuse of a Trusted Stay Badge
- A reservation, stay, injury, loss, or dispute involving the Property
- The Host's breach of these Terms
StaySafe Verified will provide reasonable notice of an indemnified claim and may participate in the defense.
This section does not require indemnification for losses caused solely by StaySafe Verified's willful misconduct where indemnification is prohibited by law.
35. Disputes Between Hosts, Guests, and Third Parties
StaySafe Verified is not a party to agreements between Hosts and Guests.
Disputes involving reservations, refunds, Property condition, access, cancellations, damage, injuries, house rules, or Guest conduct must generally be addressed between the Host, Guest, booking platform, insurer, or other responsible party.
StaySafe Verified may provide information within its possession when permitted or legally required, but is not obligated to mediate or resolve private disputes.
36. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.
This choice of law does not deprive a consumer of any nonwaivable protection provided by the law of the consumer's place of residence.
37. Informal Dispute Resolution
Before filing a legal action relating to these Terms or the Services, you and StaySafe Verified agree to make a reasonable, good-faith effort to resolve the dispute informally.
A written notice should describe:
- The person or entity bringing the claim
- The relevant account or Property
- The facts supporting the claim
- The requested resolution
- Available supporting documentation
The receiving party will have 30 days to respond before either party files a legal action, unless immediate relief is reasonably necessary or a limitations period would expire.
38. Venue
Subject to applicable consumer law and any court with mandatory jurisdiction, legal proceedings arising from these Terms or the Services must be brought in:
- The Court of Common Pleas of Adams County, Pennsylvania; or
- The United States District Court for the Middle District of Pennsylvania when federal jurisdiction exists
Each party consents to the personal jurisdiction of those courts.
Nothing in this section prevents an eligible claim from being filed in an appropriate small-claims court.
39. Electronic Communications
You agree to receive electronic communications related to the Services, including:
- Account notices
- Transaction receipts
- Review requests
- Publication notices
- Badge-status notices
- Renewal notices
- Security notices
- Policy updates
- Customer-support communications
Electronic communications satisfy any legal requirement that a communication be in writing to the extent permitted by law.
Marketing communications will include applicable opt-out methods.
You remain responsible for maintaining an accurate and monitored email address.
40. Changes to These Terms
StaySafe Verified may update these Terms when the Services, business practices, Program requirements, technology, or legal obligations change.
The “Last Updated” date will be revised when changes are made.
Material changes may also be communicated through email, an account notice, a dashboard notice, or a website notice.
When required, StaySafe Verified will request renewed acceptance.
Changes will apply prospectively unless otherwise permitted by law.
41. Assignment
You may not assign or transfer these Terms, an account, a Property membership, or a Badge license without written permission from StaySafe Verified.
StaySafe Verified may assign these Terms in connection with a merger, acquisition, financing, reorganization, transfer of assets, or similar business transaction, subject to applicable law.
42. Force Majeure
StaySafe Verified is not responsible for delay or failure caused by circumstances beyond its reasonable control, including:
- Natural disasters
- Severe weather
- Fire
- Utility failure
- Internet or telecommunications outage
- Cyberattack
- Labor disruption
- War or civil unrest
- Government action
- Public-health emergency
- Failure of a critical third-party provider
43. Severability
If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
44. No Waiver
Failure to enforce a provision of these Terms does not waive the right to enforce it later.
A waiver is effective only when made in writing by an authorized representative of StaySafe Verified.
45. Entire Agreement
These Terms, the Privacy Policy, applicable checkout disclosures, and any additional terms expressly presented for a particular Service constitute the agreement between you and StaySafe Verified regarding the online Services.
A separate signed consulting contract, statement of work, or other written agreement controls when it expressly conflicts with these Terms regarding the separately contracted services.

Section headings are provided for convenience and do not limit or alter the meaning of these Terms.
47. Survival
Provisions that by their nature should survive account closure or termination will remain in effect, including provisions concerning:
- Payment obligations
- Intellectual property
- User Content licenses
- Trusted Stay Badge restrictions
- Disclaimers
- Liability limitations
- Indemnification
- Dispute resolution
- Governing law
- Record retention
